The Michigan Public Service Commission is considering DTE's proposed rules for serving data centers and other enormous electricity users. This is our opportunity to demand strong upfront collateral -- cash or bank letters of credit that can be drawn on if these companies fail to pay.
But DTE’s proposal would let the utility decide whether a parent company’s promise to pay is enough -- and reduce the amount of financial backing required at its own discretion. What good is that promise if the parent company goes broke too?
Make these companies put their own money on the line.
Tell the Commission to require:
- Real collateral before DTE incurs major costs. Require cash or bank letters of credit sufficient to protect other customers from unpaid obligations if a project fails. Any exception must meet strict, objective financial standards and receive Commission approval.
- Protection that holds up when corporate finances don't. Require ongoing monitoring and automatic increases or replacement of financial security when creditworthiness declines or uncovered costs grow.
- Exit fees that cover the full remaining contract. DTE's proposed formula can leave years of a contract outside the exit-fee calculation. A company leaving early must remain responsible for its obligations throughout the remaining contract term, including any binding extension, with dependable collateral backing them.
- Rules DTE cannot waive on its own. Require DTE to demonstrate that every large-load customer meets these protections. Our financial security must not depend on whatever terms DTE is willing to negotiate.
If data center companies want billions of dollars in infrastructure built for them, we must require them to provide the financial backing to pay for it -- even if their plans fall apart.
Demand enforceable protections that keep speculative development and unpaid infrastructure costs off our electric bills.
